End User License Agreement — MyClouDrive

This End User License Agreement ("Agreement") is between GOLDTEK VIET NAM CO.,LTD ("Company", "we", "us") and you ("User", "you") and governs your use of the MyClouDrive application (the "App").

1. License grant

Subject to this Agreement, Company grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App for your personal or internal business purposes.

2. Restrictions

You agree not to:

  • Copy, modify, or create derivative works of the App except as permitted by law
  • Reverse engineer, decompile, or attempt to discover source code except where prohibited by law
  • Bypass, disable, or interfere with security or licensing mechanisms
  • Use the App in a way that violates applicable laws or third-party rights

3. User content and third-party services

The App may connect to third-party services or servers that you configure (e.g., cloud providers, network storage). You are responsible for:

  • Your configuration choices
  • The legality of the content you access/sync
  • Your compliance with third-party terms and policies

Company is not responsible for third-party services, outages, or data loss caused by them.

4. Updates

Company may provide updates or changes to the App. Updates may be required to continue using certain features.

5. Fees and subscriptions (if applicable)

If the App includes paid features:

  • Prices, billing period, and renewal terms will be presented before purchase.
  • Subscriptions renew automatically unless canceled.

If no payment is required for your use of the App, this section does not apply.

6. Termination

This Agreement is effective until terminated.

  • You may terminate by uninstalling the App.
  • Company may suspend or terminate your access if you materially breach this Agreement.

Upon termination, the license ends and you must stop using the App.

7. Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE.

IN ANY EVENT, COMPANY'S TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP (IF ANY) IN THE 12 MONTHS BEFORE THE CLAIM.

9. Governing law

This Agreement is governed by the laws of Vietnam, without regard to conflict of law rules.
